Retire and buy in the land of smiles.
Am I attacking your wife?
You say she's a lawyer.
Why don't you ask her?
And you are quite right with the slagging.
We are at least united in that point of view which is very good.
YOU don't want to go the company route and that's your choice not to do it.
I chose to do the opposite.
We both live in Thailand and not Europe.
Obey the laws here and stop think European for a while.
If you don't like the company route it's fine.
Nobody, especially the authorities, cares if you like it or not.
A lot of farangs have their dream-house and why should they care if somebody chooses not to buy?
This is a question up to each and anyone to decide, based on information given by Thai lawyers and advisers.
I understand you want to have a European way of thinking which is fine.
But not in Thailand if you want to have a house/property!!
You choose your way - I choose mine.
What's wrong with that?

Your post has just confirmed everything I have said up to now. You cannot argue you just slag people off. As a moderator I would have expected a little more reasoning than just slagging people off. You have gone down the company route. If your Thai partners cannot explain how they came upon the money to invest in " YOUR HOUSE " then the company is illegal. If they have put their own money into it then its not your house. Just which part of that do you refute. The Thai authorities may not bother you at the moment but then again they may. Now as well as slagging off the OP now, as I have had the temerity to disagree on such a point of law you attack me. You cannot atack through debate so you attack through personal slants. SAD SAD SAD. And you a moderator as well The forum is getting worse by the day when posters are attacked by the MODS!!!!!
My original agruement still stands tell me what he said was incorrect!!

H2ODunc,
I have no opinions on the thread (well, I do, but I've vowed to keep out of property threads, now), but I'd like to address one thing, if I may?
Just because we're mods doesn't mean we don't have personal opinions too. Sometimes we just want to express our own opinions, not sit on the fence. I can see how those will be judged in the moddy vein, but please give us some leeway for having minds, opinions and frustrations of our own, same as you guys. Believe it or not, we're human
How's your beast, BTW? Littl'un loved the pic you sent for him.

And you have just confirmed my point of view.
You are in Thailand and Thais don't care what you think.
Their country - their rules.
Has nothing do do with attacks, slags or way of thinking.
If you don't like their way of thinking, then don't buy.
As simple as that.
How is it possible to have any sort of positive debate in these questions?
Either you want to follow to rules or not is a matter of personal opinion.
Nobody is forcing you to buy a house.
Rent it if that's what you want.
I'm sorry if you feel I'm attacking you as a person, which is not true.
How is it possible to have a debate without people getting hurt?
I'm so fed up of the property matter that it makes me sick!!
People gets hurt, people loosing their house, people buying their house but we still keep on ranting and shouting about the property questions.
Why is so important to convince the other half that you are right and their wrong?
Statements like : You cannot argue, is that your good or bad side saying so?
What is there to argue about?
Don't you understand that this is why all debates about houses & properties are derailing over and over again?
We are not able to convince each other what is wrong and what is right so what's the point with endless discussions like this?
Another subject but same thread:
We had just finished another exhausting thread about properties when Onlyme started another.
That is why people react negatively.

Oh for goodness sake! No, a farang can't own land (unless you're an American who has special dispensations). However, you can own your house as I do and registered with the Tessabahn. My wife owns the land and should we divorce, then the rules are similar to the UK. i.e. 50 - 50 split (although you have to go to court). I know. I've checked.
Should your wife (owner of the land) die, then you as the Farang will own the land she leaves. But only for 90 days in which time you have to offload it or they will do it for you. So you transfer it to your kids if you have any or sell it on the open market if you wish.
Forget all this bitching and look into it yourself. I think most people would be surprised at some of the rights you have as a Farang.
Of course if you have enough money, then you can invest in government bonds and legally own some land.
This is boring.

Seems to me that most of the opposition to buy a house in Thailand comes fom those who have lived their life in the West and are frightened by the fact that the laws here are not European or North American..... so my question is...why do you want to come here ?
You would be better off buying your house in Spain or Greece or Florida...wherever the rule of law sits well on your head.........I have lived in Asia for over 25 years..I have never lived under democracy within that period and I am perfectly comfortable with my house purchase in Hua Hin... whatever anyone thinks...Those who want to live in Thailand have to understand that Asians think differently..act differently.and they cannot expect things to be the same as the "old country "..wherever that may be...
The dream of living overseas carries many risks...so stop moaning about different laws...if you want to live in Thailand..accept the laws..accept the way of the locals....or just stay where you are and leave the rest of us to enjoy paradise....

WHO CARES????? how about trying people using the web and this SITE IN PARTICULAR to get honest truthful information and thinking about purchasing in thailand (LIKE MY SISTER)
i have stayed out of this because in the past i have been slagged of and personally attacked by people with a vested interest (i smell according to one and tell a joke jeez does the cavalry come in or what)and all because as i have said continuusly i feel i am the friend taking the side of a friend and helping to get the truthful answers and asking the questions the vested interests dont want asked and dont answer in full
1 .... i agree with the original op in its contents
2......I agree NO one has been able to PROOVE that any of it is wrong
3..... I also dont understand the original ops motive ie it was not in answer or to enlighten another poster i am
4......I agree this subject has been done to death and until some major policy/law change happens it is a waste of time as each side wont change its view
5......i agree it is the vested interests that normally get personal first
6..... It was not the vested interests on this occasion that started this fair play to them
hope to be back fixed and well end of july for those interested

A Greatfull Guest of Thailand
Yes Sargeant, this subject has been done to death...but not for the new people to this forum, who have legitimate questions and concerns! I have read many opening posts by rookies and many times the responses have been: "Done that subject to death! Do a search of the archives!" The tone has not exactly been welcoming. Yes, it makes sense to look through the old threads for information related to your questions, but when you're new to the scene, you just want to get out there and start a conversation! Here's my question: "Those expats who own their own house through the 'company route': could you please tell my about the 'companies' that you operate? What does your company do? What do you sell? What do you make? " I would love to have a house in Thailand someday, when I retire. Right now I have no idea about the best way to achieve this goal: rent, put it in my Thai partner's name, company, lease, buy a condo, etc. This subject, for me anyway, has not been done to death. I do not know "Onlyme' as a person, and am not really familiar with his previous postings. I don't care. His OP was valuable. I have read nothing in response to his post that in any way contradicts his assertions. I'm still waiting. I WANT to be reassured that you can own your house legally. I would like to be armed with a clear understanding of Thai law in this regard - and if I conclude eventually that a "clear understanding of Thai law" cannot be achieved, then that is valuable too! H20Dunc's postings were completely reasonable and it is somewhat sad and just a touch amusing to observe him getting steadily more frustrated with the posters on this thread. He is only responding to the subject matter in the OP- not to the history of the "Poster".

Matthew80, as you have spotted these forums tell you nothing. If you really want to invest and make a life in Thailand, come and speak to the Thai authorities here and spend some time to get a feel for what is legit and what isnt. This forum has become a bitching board and you will learn nothing of the realities of Thai property law from it. Your only way is to go to HuaHin and work it out.
Good luck, I guess we all need it.

Arrive on the 28'th Jim! It will be my fifth visit to Hua Hin! Can't wait! With reference to this forum: I have gleaned much valuable info from some threads. I think the "Propery Ownership" subject is huge and complicated, with many different perspectives. We all have to be considerate of each other's opinions and experiences. After all, we're here to be helpful, right? Right?

Can we please keep the personal flaming out of this. There is a difference between fact and opinion and this should also be noted.
Unless we wish to adopt the moderating style of other large Thailand forums and all become trigger happy terminators on a power trip.
In respect of terms and conditions item 15 please conduct any further issues regarding moderators actions by PM or email.
I really don't know why I have to step in on every property thread and reprimand people or worse. It shouldn't be necessary, we are all adults here lets share the knowledge and experiences we have in a civilized manner - that is the purpose of this forum.
And to whoever posted that, since when have moderators not been entitled to have their say or an opinion? And you a moderator as well The forum is getting worse by the day when posters are attacked by the MODS!!!!!

Pray tell us, what happens after the 90 days if you haven't offloaded to your kids/sold etc?Should your wife (owner of the land) die, then you as the Farang will own the land she leaves. But only for 90 days in which time you have to offload it or they will do it for you. So you transfer it to your kids if you have any or sell it on the open market if you wish.
Auction in Bangkok for 100,000 baht?
Onlyme.
PS. I was genuinely offering advice to any newbies (especially if foreign couples ) on the purchasing of properties in Thailand.

It's not rocket science, it's simple economics:gaijin wrote:All the negative posts seem to come from those who do not own property in HH. All the positive posts are from those who have bought property in HH. Why is this so?
- If you don't have a property and were thinking of or hoping to buy you would want as much negativity as possible to lower the price you pay.
If you already have a property and were thinking of or hoping to sell now or in the future you would want as much positivity as possible to raise the price you receive.
