If I marry my Girlfriend in Budhist Ceremony Only - not Town Hall Ceremony - what does she then inherit and what are her rights ?

If you are asking strangers these questions, why are you marrying her.

If you think she is in it for the money get shut of her.

"what does she then inherit" could suggest that he wants to make sure she's taken care of when he's dead.

As far as I know a Bhuddist ceremony for marriage is not legally binding. To be bound legally the marriage must be registered with the Thai authorities, i.e. in Hua hin, the Ampur. And if she wants to be sure to inherit after you, the marrriage should also be registered with the embassy of your home country.

To qualify to continue receiving my pension etc it is definitely marriage that is required. A will would not be recognised by the UK Government for this purpose.

Really? I'm curious as to why that would be.

The UK Government will only pay out to my legal spouse. If I have an 'unmarried' partner - they could be eligible for something, but only a fraction of what a married partner would receive.

I would imagine you would have to give them a huge amount of proof of relationship if not married and this could prove to be a massive challenge for a thai.

I think it is just what it say's ...a ceremony...means nothing legally...
but if you have will or prior leagal agreement with her thats what she get if you die
but
If you register the marrige at the ampher office then she is entittled to get what ever thai marriage laws state in case of your death
I guess..

Yes, I make you right in the above as far as Thai assets go. Having a Thai will is incredibly important as without one inheritance automatically goes to six classes of statutory heirs, of which a legal spouse is not one of, a legal spouse is only entitled to a share with these heirs. Irrespective ective of whether Thai or Foreign.
Statutory Heirs:
1) Descendants;
2) Parents;
3) Brothers and sisters of full blood;
4) Brothers and sisters of half blood;
5) Grandparents;
6) Uncles and aunts.

A legal spouse only inherits 100% when all the above are not around OR do not have qualifying representation (ie: if your wife's descendants are not living their descendants can inherit the share), otherwise it's just a share. This might be straight forward if farang dies, but if Thai wife does then the surviving farang spouse will only have an equal share with however many children she may have, say 3 kids from a Thai man, then the 4 of you get a 25% share each. This would apply to your own kids with the wife if neither of you were around.

If no kids then surviving spouse 50/50 share with any parents, next brothers/sisters and so on. Can you imagine the fun and games trying to get your share out :shock: or if just your own child was left to inherit 50/50 with a previous child of your wife's that the family in the village have been bringing up for the past 10 years. Would they do the right thing and give our 5 year old his half, or consider it their compensation for the last 10 years :?

Lot easier to do a will.

:cheers:

The village ceremony means dick, register if want any legal meaningfulness, which is probably why many normal Thais just do the fake village ceremony rubbish.

As for the rest, take your time and no hurry, just have fun and be sure with a woman, otherwise you might find she has something in common with this Queen song.
