Fair enough I can understand but just one question if the HHAD forum / moderators were to know or find out who the people are and knew it to be true would they then ban / stop the company from advertising on the forum or still take the money. Individuals get banned for saying / doing things which are deemed unappropriate how come you cannot do it to companies.

Also begs the question as to what practical advice can you give to someone who has suffered to try and seek compensation given that the libel/slander laws are so strict.
Legal redress also seems futile taking perhaps years before there's even a date for a court hearing set down let alone the chances of success?
Is it just that there's very little consumer protection existing in Thailand ?? and Buyer beware applies at all times....

Buyers beware? OF COURSE!!
When you are investing a whole lot of money in a property development, don't you for a minute consider the consequences of what you are doing?
Do your homework and read the advises given by other HHAD-members in a countless number of threads before you sign any paper or hand over one single Baht.

Solid evidence is one thing, but when you are hiding behind a keyboard and provides us with rumours and hearsay then it means nothing.
Privately you can do what you want but not on a public board like HHAD.
We've received too many threats and warnings of legal actions against us that we simply don't want to take the risk.
None of the mods or Admin are involved in the property business and we have no intention to get involved either!!

15+% (or however much the market can bear) as a starting point allows plenty of room to manoeuvre downwards depending on how savvy the buyer is and their negotiating skills.
Also it allows for 'free' extras to be added in to clinch the sale.
If you go direct to a developer who is willing to sell and cut out the middleman commission you should be able to get an appropriate discount - especially now in an over-traded market.

Just a generic question. All developers of any size always have sales girls who stick with you from start to finish. It's obvious to me they are on commission as part of their package. What % do these girls personally get at closing? Pete

The agents are XXXX Property also known as XXXX Property Shop.
My refundable deposit was $5000.00 dollars cash Australian.
The loss of the money means another year I will have to save. However their promises to pay and not do so is the most distressing.
I have offered all sorts of solutions assuming they were encountering financial difficulties.
If they could just be honest it would help.

yes this company has been in trouble for sometime now, in fact, i dont know how they have stayed open for the past 6 months.
i seriously believe you wont see your money again.

I had told them of a property I was intersted in. They promised that they would find me one.
They did not so found it and contacted the owner.
I requested my refund in less then 24 hours after paying it.
A designanted representive contacted in person on the 19th March the next day, I was actually in the car with him but stayed outside.
Twice this occurred . I left Ch Am on the 21st since then there have been numorous requests and promises I have even offered to purachase a vehicle from them and pay the differnce if they were having financial difficulties.

Chopsticks if you can get any developers to sign up for 15% I will happily represent them. Well actually not as I would simply make an ass of myself trying to sell overpriced properties. Even major international companies that sell off plan via exhibitions worldwide and have corporate offices in prime locations,television advertising etc. charge way less than that. As for negotiating price out of commission. That is quite Thai on land deals which is why you have to bind them into a written contract. If I list a property at a price and agree a percentage deal with a broker then the percentage stands whether they get the asking price or I drop a little. It is based on the actual sales price.

Thank you guys, I'm getting more and more scared!
It sure sounds like it's a "real estate zoo" out there in HH! In Hawaii we have bonded escrow companies handeling all transactions and neither the seller or the seller's agent get a penny before the transaction is closed! Escrow also pays the agent of the buyer before distributing the funds. (It's the same with new developments and developers too.)

As to those that questioned our advertising policies, would you blame a newspaper if it ran an advertisement for a bank or company that fell foul of its investors? Probably not so less of the finger pointing towards HHAD.PROPERTY ISSUES
