One other problem not being discussed is the cost for a foreign couple 2 x 800k to be tied up, that is a fair amount of cash

[Edit] :idea: Maybe this is the reason the show money is double that for somebody married. Marriage visa is to cover one person, whereas a Retirement visa could be covering 2 people.

A possible way out for those meeting the income requirements, but don't have savings here....is a trip to the Thai Embassy in your home country, they will issue you with a one year visa based on your proven income and/or income + savings. The return ticket will cost you about the same as you will pay an "agent" to circumvent the law....I know which option I would prefer...

They both have to come up with 800k. A marriage visa only applies if you are married to Thai citizen, not if both of you are foreign.

You are correct in that a marriage visa only applies to a foreigner married to a Thai. However, you are referring to retirement (800K). In a foreign marriage, only one needs to cough up the 800K and the other 'piggy backs' as a dependent. I think wires have been crossed.

Getting a retirement visa in Thailand with your western spouse

Many foreign couples retire in Thailand every year and it’s important to understand that the retirement visa rules are slightly different when a couple wish to obtain a retirement extension of stay together.

The procedure is as follows:
Both partners independantly obtain their retirement visas and both have to show either 800,000 baht in a Thai bank account, income of 65,000 baht per month or a combination of the two. (this is an option, NOT a requirement)

One partner obtains a retirement visa (usually the man) and the wife receives a visa as his dependent

Thai immigration rules have changed twice in the last 10 years to move against the dependency visa allowance but have later been revised on both occasions.
If possible, the best situation is for you both to get independent visas as a dependency extension would become null and void upon the death of the main visa holder and could cause a lot of stress surrounding visa situations at a sensitive time.
(this is good advice if you can afford it!)

We can now advise that at the Immigration office in Chonburi/ Jomtien they are not asking to see both the foreigners with the financial side but only the male side of the marriage can show the financial so:

If you are using the 800,000 baht in the bank then the money can only be in the man’s name not the wife or a joint bank account.
If you are using an income and not the money in the bank then the income letter obtained from your Embassy or Consulate must only be in the mans name not joint names. (now obviously of no use)

You must also show your original marriage certificate and if not in English it must be translated to English.

That is very interesting regarding the fact the man needs to have show money. I knew I was right because I had friends piggy backing, but in that case, it was the lady who had the show money. A case of TIT I guess it depends who is sitting behind the desk at the time of application.

This is precisely why I for one will not jump anywhere yet. We're living in Thailand, reality is how Thais interpret their own rules and regulation. Hence my personal interest in seeing how the Danes get on.

I wont read the law, I will take notice of the Thai interpretation. Once they've decided the way forward, any attempted injection of rules will lead to loss of face, and that won't happen.

There is no argument regarding the marriage visa. With a retirement visa for foreign couples, only one needs the 800K and the other as a dependent. However, the rules changed in that the spouse acting as a dependent is now required to be under 50. Once accepted as a dependent, then it will grandfather past the age of 50, but initially the dependent spouse must be under 50.
