My 1st thought was what a perverse situation the FA found it itself in! Having to adjudicate between two foriegn nationals, how they individually interpret Spanish, based on their respective backgrounds and the nuances of how a term commonly used in Uruguay came to be used on a football pitch in the NW?BaaBaa. wrote:Did you read any of that report Caller?

They have been very thorough in examining all that happened, for example, the 'pinch' and then explaining the reasons for their decison, throwing in a lot of hearsay stuff about who said what to whom immediately after the game, their demeanour at interview and body language on the pitch between the two? Although we have to rely on what they have chosen to publish in their report as being the full story.
At the end of the day, as they said at the outset, they are looking at 'balance of probablities', which is all that is needed at the civil level. It wouldn't stand a hope in hell at the criminal level, which requires 'beyond doubt' because as much as they dress it up, it all comes down to one persons word against another.
I was interested that the referee stated that on the first 2 occassions when Evra claims to have told him he had been racially abused, the ref couldn't recall any such accusation? And it was only when Evra was booked that he can recall Evra saying any such thing. They described the referee as a credible witness, as they did Evra, but to me, I would have thought that was the sort of comment a referee would recall?
I also felt they accepted the discrepencies in Evras evidence, such as above as well as what he said to French TV immediately after the game, whilst rejecting Suarezs. Although they have stated their reasons for that, a lot seemed subjective to me?
I was intrigued by their choice of expert witnesses re: the language used and its meaning. Can't argue with the credentials of the 2 English experts used, but as they were being so thorough, why not have a 'native' expert in Uruguyan Spanish and its use in the area where Suarez comes from as well? I thought their evidence crucial and I'm sure ripe for challenge if there had been an appeal?
Anyway, its all academic now. It seems the FA found Evra and United credible and Suarez, Comolli and Dalgliesh less so? I can understand why Liverpool feel so aggrieved.
If any good comes out of this, it appears that the legal profession is now taking note of the FA and above's disciplinary procedures and are questioning its impartiality?

Are the Liverpool crowd now being singled out for every alleged slur on a player as reported after the game against Oldham? Next we will have referees accusing all sections of spectators for the chant of "the referee`s a w****r. Then again it`s only slander if it`s not true!
